1. Acceptance of Terms

By downloading, installing, or using any mobile application ("App") developed by Tap Water ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use our Apps.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our Apps on a device that you own or control, solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in these Terms.

3. User Accounts

Some of our Apps may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if we suspect unauthorized or fraudulent activity.

4. Prohibited Conduct

You agree not to:

• Use our Apps for any unlawful purpose
• Reverse engineer, decompile, or disassemble any part of our Apps
• Modify, adapt, or create derivative works based on our Apps
• Distribute, license, sell, or lease our Apps to third parties
• Use our Apps to transmit harmful, offensive, or infringing content
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of our Apps
• Use automated means to access or collect data from our Apps

5. Intellectual Property

All content, features, and functionality of our Apps — including but not limited to text, graphics, logos, icons, images, audio, video, software, and code — are the exclusive property of Tap Water or our licensors and are protected by intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any part of our Apps without our prior written consent.

Except for the limited license granted to you in Section 2, you have no right, title, or interest in or to our Apps or any of their content. Any unauthorized use of our intellectual property is strictly prohibited.

6. User Content

If our Apps allow you to submit, upload, or share content ("User Content"), you retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of operating and improving our Apps.

You represent and warrant that your User Content does not violate any third-party rights or applicable laws.

We reserve the right, in our sole discretion, to remove or disable any User Content that we believe violates these Terms, infringes any rights, or is otherwise objectionable or harmful.

7. In-App Purchases and Subscriptions

Some of our Apps may offer in-app purchases or subscriptions. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.

• Prices are displayed before purchase and may vary by region
• Subscriptions automatically renew unless canceled before the renewal date
• You can manage subscriptions through your device settings
• Refunds are handled according to Apple's refund policy

8. Disclaimer of Warranties

Our Apps are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our Apps will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Tap Water shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our Apps
• Any unauthorized access to or use of our servers and/or personal information
• Any interruption or cessation of transmission to or from our Apps
• Any bugs, viruses, or other harmful components transmitted through our Apps

10. Indemnification

You agree to indemnify, defend, and hold harmless Tap Water and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our Apps or your violation of these Terms.

11. Termination

We may terminate or suspend your access to our Apps at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our Apps will immediately cease.

13. PeekSafe-Specific Provisions

This section applies only to users of PeekSafe. If you do not use PeekSafe, this section does not apply to you.

PeekSafe is a parental awareness application that helps parents and legal guardians stay informed about their child's publicly visible social media activity. You acknowledge and agree that:

• PeekSafe is intended only for use by individuals who are 18 years of age or older, and who are either (a) the legal parent or legal guardian of the minor whose public social media handle is entered, or (b) entering their own public handle.
• PeekSafe accesses only publicly available content from public social media profiles. PeekSafe does not access private accounts, private messages, or any non-public content, and does not attempt to bypass the authentication or privacy controls of any platform.
• You are solely responsible for ensuring that your use of PeekSafe complies with all laws applicable in your jurisdiction, including laws concerning parental monitoring, privacy, and data protection. Some jurisdictions may impose specific restrictions on monitoring others, including minors.
• The AI-generated safety analysis provided by PeekSafe (powered by OpenAI) is generated automatically and is provided for informational purposes only. It is not a substitute for professional psychological, medical, legal, educational, or law-enforcement advice, and you should not rely solely on PeekSafe's AI outputs when making critical decisions regarding the welfare of a minor.
• When you use the AI Analysis feature, content from the public profiles you choose to monitor will be transmitted to a third-party AI provider (OpenAI). Use of the AI Analysis feature requires your explicit consent during onboarding, as further described in our Privacy Policy. You may decline to use the AI Analysis feature, or delete your account, at any time.
• To the maximum extent permitted by law, Tap Water disclaims all liability for any decision made or action taken in reliance on content provided by PeekSafe, including AI-generated analysis.

14. PinScape-Specific Provisions

This section applies only to users of PinScape. If you do not use PinScape, this section does not apply to you.

• This App is an independent pin identification and collection tool. It is not owned, operated, sponsored, licensed, or endorsed by The Walt Disney Company, any of its subsidiaries or affiliates, or any other theme park or entertainment company. Any references to Disney, Disneyland, Disney pins, or other third-party brands are used solely for descriptive and informational purposes, and do not imply any official association, approval, or endorsement. All Disney-related names, logos, and other intellectual property are the property of The Walt Disney Company or their respective owners.
• Our App may integrate, include, or link to third-party websites, applications, or services (collectively, "Third-Party Services"). These Third-Party Services are not under our control, and we are not responsible for their content, policies, or practices. Your use of Third-Party Services is at your own risk and is subject to the terms and privacy policies of those third parties. We do not endorse, and assume no liability for, any Third-Party Service.

This App allows you to submit, upload, or share content, including but not limited to pin information (metadata such as name, set, edition size, and release year), photos, names of collections and display boards, community posts, trade offers, messages, and other materials (collectively, "User Content"). You retain ownership of your User Content.

By submitting User Content to this App, you irrevocably grant Tap Water a worldwide, royalty-free, non-exclusive, transferable, sublicensable license to use, host, store, reproduce, modify, adapt, translate, display, publicly perform, and distribute your User Content to the extent reasonably necessary, including for the following purposes:

• operating, maintaining, and improving this App and related services;
• training and optimizing our artificial intelligence models and algorithms;
• building and refining our product databases and catalogs;
• marketing and promoting this App and our other products;
• sharing data with partners within a reasonable scope in order to provide better services.

We may, in our sole discretion and without prior notice, remove any User Content or disable access to it if we believe that it violates these Terms, infringes the rights of any third party, or is otherwise inappropriate or harmful.

You represent and warrant that:

• you have all rights, licenses, and authorizations necessary to submit such User Content and to grant the licenses above;
• your User Content does not infringe, misappropriate, or violate any third-party rights (including, without limitation, copyright, trademark, patent, rights of publicity, privacy, and moral rights), and does not violate any applicable law or regulation;
• if any third-party claim or lawsuit arises from your User Content, you shall be solely responsible for all resulting legal liability and shall indemnify Tap Water for all losses suffered as a result.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms within our Apps and updating the "Last Updated" date. Your continued use of our Apps after changes are posted constitutes your acceptance of the revised Terms.
