Welcome to Tap Water ("Company", "we", "us", or "our"). We are committed to protecting your personal information and your right to privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile applications (collectively, the "Apps").

Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, please do not access or use our Apps.

2. Information We Collect

2.1 Information You Provide

We may collect information that you voluntarily provide when using our Apps, including:

  • Account registration information (e.g., name, email address, username, and profile picture)
  • Profile information
  • User-generated content (e.g., pin photos, collections, notes, tags, categories, and other details you choose to store in the App)
  • Communications with us (e.g., customer support inquiries, feedback, bug reports, feature requests, reviews, survey responses, or other communications)

2.2 Automatically Collected Information

When you use our Apps, we may automatically collect certain information, including:

  • Device information (e.g., device model, operating system version, application version, language, time zone, and country or region)
  • Usage data (e.g., features used, screens viewed, taps and gestures, time spent in the App, and dates and times of activity)
  • Crash reports, error reports, and performance metrics (diagnostic data) used to monitor reliability and improve stability
  • IP address and general location information

2.3 Photos, Camera, and Image Content

If you use features that allow you to scan or capture images:

  • The App may access your device's camera and/or photo library in order to capture or select images.
  • Our image recognition and matching systems may process photos and related image content to help identify items, provide relevant information, or improve our recognition models.
  • You may store photos and related data in your collections, boards, or history so that you can view, edit, and manage them at any time.
  • You may disable camera or photo access at any time through your device settings, but doing so may limit or disable certain core features of the App.

3. How We Use Your Information

We use the collected information for the following purposes:

  • Providing, operating, maintaining, and improving our Apps
  • Personalizing your experience
  • Communicating with you about updates, promotions, important notices, security alerts, and support
  • Analyzing usage trends to improve our services, performance, and user experience
  • Ensuring the security and integrity of our Apps and preventing fraud, abuse, or misuse
  • Complying with legal obligations and enforcing our terms of service or other agreements

Subscriptions and all in-app purchases are processed through the Apple App Store. We do not collect, process, or store your full payment card information or billing information. Apple may collect and process certain transaction data in accordance with its own privacy policy and terms.

4. Data Sharing and Disclosure

We do not sell your personal information, nor do we use personal information for third-party advertising or independent marketing purposes. We may share your information in the following circumstances:

  • Service Providers: We may share information with trusted third-party vendors who provide services on our behalf (e.g., analytics, cloud hosting, cloud storage, crash reporting, customer support). These vendors are only permitted to use the information to the extent necessary to provide their services and are obligated to keep it secure.
  • Legal and Safety Requirements: We may disclose information where disclosure is reasonably necessary to comply with a law, regulation, legal process, or governmental request; to enforce our agreements; or to protect the rights, property, or safety of us, our users, or others.
  • Business Transfers: In connection with a merger, acquisition, sale of assets, or similar transaction, your information may be transferred. We will take reasonable steps to ensure that your information continues to be protected.
  • With Your Consent: We may share information with your explicit consent.

5. Data Security

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

6. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. When we no longer need your information, we will securely delete or anonymize it.

Depending on your location, you may have the following rights regarding your personal information:

  • Access and receive a copy of your data
  • Rectify inaccurate or incomplete data

Our Apps are not intended for children under the age of 13 (or the minimum age required for parental consent in your jurisdiction). We do not knowingly collect personal information from children under 13. 9. Third-Party Links

Our Apps may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to read the privacy policies of any third-party services you access.

10. Artificial Intelligence Services

Some of our applications may incorporate artificial intelligence ("AI") technologies. If the application you are using does not include AI features, this section does not apply to you.

When you use AI-powered features:

  • We may collect and process the content you submit (such as text, images, or audio) to generate AI responses and improve service quality.
  • We may use third-party AI service providers (such as OpenAI, Google, or Anthropic) to process your data. Your data may be transmitted to servers located outside your country of residence.
  • AI interaction data is retained only as long as necessary to fulfill your request, unless otherwise required by law.
  • We do not use AI to make automated decisions that produce significant legal effects on you without human oversight.
  • AI features are not intended for children under the age of 13. We do not knowingly collect children's data through AI features.

11. SkyDecode-Specific Provisions

This section applies only to users of SkyDecode. If you do not use SkyDecode, this section does not apply to you.

SkyDecode provides a listening experience based on airport tower and simulated flight audio. Specifically:

  • Flight audio within SkyDecode is simulated content designed to emulate the style of cockpit and flight crew communications. SkyDecode does not capture, record, or transmit any audio from you or your private communications.
  • SkyDecode does not request access to your device's microphone, and we do not collect any audio from your surroundings.
  • We may collect non-identifying usage information related to your in-app activity, such as which channels or airports you select and how long you listen, in order to improve the content library and overall experience.
  • Any callsigns or flight identifiers featured in simulated flight audio are illustrative only and do not reflect actual real-time aviation activity.

12. PeekSafe-Specific Provisions

This section applies only to users of PeekSafe. If you do not use PeekSafe, this section does not apply to you.

PeekSafe is a parental awareness application that helps parents and legal guardians stay informed about their child's publicly visible social media activity. The following provisions describe how PeekSafe collects, uses, and shares data, in addition to the general provisions of this Privacy Policy.

12.1 Data Collected by PeekSafe

  • Social media handles and usernames you voluntarily enter for the public accounts you wish to monitor (your child's public handle, or your own public handle).
  • Public posts, public images, public usernames, post timestamps, and public engagement counts (such as likes and comment counts) retrieved from the public profiles you choose to monitor.
  • AI-generated safety analysis results returned to your device.
  • Account and subscription information, such as your email address and subscription status.

PeekSafe does not access:

  • Private accounts, private messages, or any non-public content on any social platform.
  • The contents of your child's device, screen activity, keystrokes, or private communications.
  • Any data that requires bypassing the authentication or privacy controls of any third-party platform.

12.2 Use of OpenAI for AI Safety Analysis

PeekSafe uses OpenAI, L.L.C. ("OpenAI"), a third-party AI service provider headquartered in the United States, to generate safety risk summaries from the public social media content you choose to monitor. When you trigger an AI analysis:

  • The following data is transmitted to OpenAI's API over an encrypted HTTPS connection: public post text, public images, public usernames, and post metadata.
  • Your account email, password, payment information, and device identifiers are not shared with OpenAI.
  • OpenAI processes this data under the OpenAI API Data Usage Policy, which prohibits OpenAI from using API data to train or improve its models, and which provides data protection equivalent to the standards described in this Privacy Policy.
  • OpenAI retains API data for a maximum of 30 days for abuse monitoring, after which it is deleted.

12.3 Your Consent and Control

  • You provide explicit consent to the data sharing described in Section 12.2 during the PeekSafe onboarding flow, before any data is sent to OpenAI.
  • If you do not consent, the AI Analysis feature cannot be used.
  • You may delete your PeekSafe account at any time, which will terminate any further data sharing associated with your account.

12.4 Children and Guardianship

  • PeekSafe is intended exclusively for use by individuals who are 18 years of age or older.
  • You confirm during onboarding that you are either the legal parent or legal guardian of the minor whose public social media handle is entered, or that you are entering your own public handle.
  • PeekSafe accesses only publicly available content from public social media profiles. PeekSafe does not create accounts for children, and does not directly collect personal information from children under the age of 13.
  • You are responsible for ensuring that your use of PeekSafe to monitor a minor complies with all laws and regulations applicable in your jurisdiction.

13. PinScape-Specific Provisions

This section applies only to users of PinScape. If you do not use PinScape, this section does not apply to you.

13.1 Important Non-Affiliation Notice

PinScape is an independent pin identification and collection tool. It is not owned, operated, sponsored, licensed, or endorsed by The Walt Disney Company, any of its subsidiaries or affiliates, or any other theme park or entertainment company. Any references to Disney, Disneyland, Disney pins, or other third-party brands are used solely for descriptive and informational purposes to help you organize and identify your own pin collection, and do not imply any official association, approval, or endorsement. All Disney-related names, logos, and other intellectual property are the property of The Walt Disney Company or their respective owners.

We are not affiliated with The Walt Disney Company, and we do not share user data with Disney or any Disney-branded service for marketing, analytics, personalization, or any other independent purpose.

13.2 Legal Basis for Processing (EEA/UK)

If you are located in the European Economic Area (EEA), the United Kingdom (UK), or a similar jurisdiction, we process your personal data on one or more of the following legal bases:

  • Performance of a contract: Processing necessary to provide the App and the related services you have requested.
  • Legitimate interests: Improving, securing, and operating the App in a manner that does not override your rights and freedoms.
  • Consent: For certain optional features, analytics, or legally required communications, we rely on your consent. You may withdraw your consent at any time, although this will not affect the lawfulness of processing carried out before withdrawal.

13.3 International Data Transfers

We may process and store information in the United States and other countries where we or our service providers operate. Data protection laws in these regions may differ from those in your country of residence. Where required, we put in place appropriate safeguards to protect international data transfers, such as contractual protections or other legally recognized mechanisms.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy within our Apps and updating the "Last Updated" date. Your continued use of our Apps after any changes constitutes your acceptance of the updated Privacy Policy.
